Child support is critical for the care of minor children, which is why the non-custodial parent is required to contribute with said support, until the minor is of legal age or for life in the case of children with special needs.
Different factors are taken into account to determine child support, these factors are the following:
- It must be proportional to the income of the parent who the children are dependent on, and the needs of the recipient of said benefits (the child).
- Additionally, the amount for child support benefits is determined by the circumstances of each parent, the parent with custody and the non-custodial parent.
Documents needed to claim Child Support:
- The child’s birth certificate
- Identity document for the parent or guardian submitting the claim
- Proof of address for the minor and the respondent
- Supporting documents for the child’s expenses
Phases of the process:
- Mediation: Conducted at the Children and Adolescents Prosecutor’s Office with jurisdiction based on the child’s domicile.
- Judicial Proceedings: Heard by a court with jurisdiction of Children and Adolescents cases, based on the minor’s domicile.
Features of the process:
- Quick
- Free

A) Prison
B) Impediment to leave the country
C) Retentive embargoes of Payroll accounts
