Trademark classification in the Dominican Republic

We titled the article Trademark Classification in the Dominican Republic, explicitly to establish that the Classification of Marks is not based on countries, it is based on international classification. Registrations are made based on the “Nice Classification”, which is an international agreement.

Currently, 83 States are party to the Nice Agreement. This classification is also used by the trademark offices of more than 65 countries, which are not currently party to the Nice Agreement, four organizations and the WIPO International Office, established in the Lisbon Agreement concerning the Protection of Origin Designations and their International Registration.

It is common practice for many individuals and legal entities to register their brands in different countries, in order to maintain their protection. One of the basis of brands is territoriality, i.e., it is only protected in the country where it is registered.

The Nice Classification is nothing more than a classification of products and services under an international numbering system.

Brand: Any sign or combination of signs susceptible to graphic representation, facilitating the distinction of products or services from one company to products and services from a different company.

INTERNATIONAL CLASSIFICATION OF PRODUCTS AND SERVICES

CLASS 1 Chemicals used in science, manufacturing and photography, as well as in agriculture, horticulture and forestry, unprocessed artificial resins, unprocessed plastics, manures, fire extinguishing compositions, tempering and welding preparations, chemical substances for food preservation, tanning substances and adhesives used in manufacturing.
CLASS 2 Paint, varnishes, lacquers, antioxidant products and wood preservation products, dye materials, mordants, raw natural resins, sheet and powder metals for painters, decorators, printers and artists.
CLASS 3 Bleaching preparations and other substances for laundry use, preparations for cleaning, polishing, degrease, scouring, soaps, perfumery products, essential oils, cosmetics, hair lotions and dentifrices.
CLASS 4 Oils and greases for industrial use, lubricants, absorbing products, spray and settle dust, fuels (including gasoline for engines) and lighting materials, candles and lighting wicks.
CLASS 5 Pharmaceutical and veterinary products, hygiene and sanitary products for medical use, dietary substances for medical use, baby food, plasters, dressing material, material for dental fillings and imprints, disinfectants, products to eliminate harmful animals, fungicides and herbicides.
CLASS 6 Common metals and their alloys, metal building materials, transportable metal constructions, metal materials for railways, non-electric metallic cables and wires, metal locks and hardware, metal pipes and tubes, safe boxes, metal products not included in other classes and metal ores.
CLASS 7 Machines and machine tools, engines (except for land motor vehicles), couplings and transmission components (except for land vehicles), automated agricultural instruments and egg incubators.
CLASS 8 Manual tools and instruments, cutlery, forks and spoons, bladed weapons, knives and razors.
CLASS 9 Devices and instruments of various nature, e.g., scientific, nautical, surveying, photographic, cinematographic, optical, weighing, measuring, signalling, control (inspection), life-saving and teaching, conducting devices and instruments, distribution, transforming, accumulating, regulating or to control electricity, recording devices, transmission or reproduction of sound or images, magnetic data carriers, recording discs, automatic distributors and mechanisms for coin-operated devices, cash registers, data processing equipment and computers, calculating devices and fire extinguishers.
CLASS 10 Devices and instruments of various nature, e.g., surgical, medical, dental and veterinary, limb replacements, artificial eyes and teeth, orthopedic items and suture materials.
CLASS 11 Lighting devices, heating, steam generators, cooking, refrigerating, drying, ventilating, water supply and sanitary facilities.
CLASS 12 Vehicles, devices for locomotion by land, air or water.
CLASS 13 Firearms, ammunition and projectiles, explosives and fireworks.
CLASS 14 Rare metals and their alloys, as well as items made of these materials (or coated with them) not included in other classes, jewelry, costume jewelry, precious stones, watches and chronometric instruments.
CLASS 15 Musical instruments.
CLASS 16 Paper, cardboard and items made from these materials not included in other classes, printing products, binding material, photography, stationery items, adhesives (glue) for stationery purposes or household use, material for artists, brushes, typewriters and office supplies (with the exception of furniture), instructional or teaching material (with the exception of devices), plastic materials for packaging (not included in other classes), block letters and printing clichés.
CLASS 17 Rubber, gutta-percha, latex, asbestos, mica and products made of these materials not included in other classes, semi-finished plastic product, caulking, stopping and insulating materials and flexible nonmetallic tubes.
CLASS 18 Leather and imitation leather, products made of these materials not included in other classes, animal skins, suitcases, umbrellas and canes, whips and saddlery.
CLASS 19 Non-metallic building materials, rigid non-metallic construction tubes, asphalt, fish and bitumen, transportable non-metallic constructions and non metallic monuments.
CLASS 20 Furniture, mirrors, frames, wood products, cork, cane, reed, wicker, horn, bone, ivory, whale, shell, amber, nacre, sea foam, substitutes for all these materials or plastic materials, not included in other classes.
CLASS 21 Utensils and containers for domestic and culinary use; combs and sponges, brushes; materials for making brushes, cleaning materials, steel wool, raw or semi-finished glass (with the exception of construction glass), glassware, porcelain and earthenware not included in other classes.
CLASS 22 Ropes, strings, nets, tents, tarpaulins, sailing sails, sacks and bags (not included in other classes), padding and filling materials (with the exception of rubber or plastic materials) and raw fibrous textile materials.
CLASS 23 Yarns and threads, for textile use.
CLASS 24 Textiles and textile goods, not included in other classes, bed and table covers.
CLASS 25 Clothing, footwear and headgear.
CLASS 26 Lace and embroidery, ribbons and tapes, hooks and eyelets, pins and needles, buttons and artificial flowers.
CLASS 27 Carpets, doormats, mats, linoleum and other floor coverings, wall tapestries not made of textile materials.
CLASS 28 Games and toys, gymnastic and sporting articles not included in other classes and decorations for Christmas trees.
CLASS 29 Meat, fish, poultry and game meat, meat extracts, fruits and vegetables, garden produce and pulses, frozen goods, dried and cooked fruits, jellies, jams, compotes, eggs, milk and dairy products, edible oils and fats.
